Baguio government appeals RTC ruling on Gibraltar Market case

BAGUIO CITY — The City Government will avail of legal remedies against  the decision of the Regional Trial Court (RTC) on the Gibraltar Satellite Market Case.

The Gibraltar Market Vendors Association had filed a civil case for forcible entry against the City Government of Baguio before the Municipal Trial Court in Cities (MTCC) which was dismissed.

However the Association sought an Appeal before the Regional Trial Court (RTC), which reversed the ruling of the MTC, and ordered the City Government, and its project contractor, to vacate the lot on which the four-story upgraded satellite market building was to be constructed.  

An earlier suit was already filed by the same Association seeking to restrain the City from implementing Demolition Order No. 49-2023. 

This case was raffled to a different RTC Branch, which denied the prayer of the Association for the issuance of a Writ of Preliminary Injunction, which Order is also currently pending on Appeal.

It will be recalled that the City Government on Dec. 4-7, 2023 demolished 120 illegal stalls occupying a lot intended for the barangay satellite market project at Gibraltar barangay by virtue of Demolition Order No. 49-2023 for lack of building permit.

The City intended for the upgraded Satellite Market Building to replace the decrepit makeshift structures that served as an eyesore in the area.

The new facility would have better served market goers not only in Gibraltar but also in other barangays in the vicinity. 

This will maximize the use of the land which the City had earlier identified for public needs.

The occupants of the new market would be determined through a joint evaluation by the City and the Vendors since use of some of the market stalls had already been transferred to third person.
